The Follow-up of International Human Rights Organizations on Gonabadi Dervish Rights Violations/The Lack of Judicial Accountability

The Judiciary’s Civil Rights office, in response to the families of imprisoned Gonabadi Dervishes’ follow-up on their complaints regarding the case of Dervish rights violations and their health status, said: “Your letter has remained unanswered and has probably not been investigated yet.”

According to Majzooban Noor, a letter of complaint has been sent to the Judiciary’s Civil Rights office by the families of jailed Dervishes on Dey 10, 1391 (December 30, 2012) which in they have mentioned to civil rights violations in the case of the prisoners of conscience such as:
*The non-observence of the legal rules and regulations necessary for holding public and revolutionary court.
*The minimum term of imprisonment for these crimes had expired and therefore the accused were illegally kept in custody (which shows that the judge is no more committed to the principle of non-partisanship and should himself be prosecuted according to 575 of the Islamic criminal code for disregarding the rights of accused).
*The investigation of this case has been transferred by the prosecutor to the agents of the ministry of information, though in this case the security forces are themselves one side of the conflict and can not act as the agents of the court.
*The legal representatives of the accused had no access to the contents of the case and no permission to meet with their clients (without presenting the case and all the related evidence, no court can be held, our lawyers at no time had any access to the contents of this case) , but it seems that their letter has been quite ignored.
It is very unfortunate while International Human Rights Organizations has reacted very serious and widespread for human rights violations in Iran , particularly the behavior of authorities with jailed Muslim Dervishes, the Judiciary’s Civil Rights office, does not consider these issues such as “hunger strike”, “torture” ( to keep prisoners naked in cold weather) , “beating”, “suffering of serious disease such as “asthma” and “warning’s doctors over the risk of amputation”, as important and verifiable matters and after three months, the Judiciary’s Civil Rights office has not even reviewed their letter of complaint yet.

International Human Rights Organizations including Amnesty International, European Parliament, German Foreign Ministry and… by issuing a statement reacted and expressed concern about the situation of jailed Dervish lawyers and hunger strikers. Also Iranian Nobel Peace Prize winner Shirin Ebadi by sending letter to Dr. Ahmed Shaheed expressed her concern about them!
