The trial hearing for Gonabadi Dervish, Mostafa Abdi was held at Branch 15 of Tehran Revolutionary Court yesterday on 9 Ordibehesht 1392 ( April 29, 2013).
According to Majzooban Noor website, the morning of Monday, Ordibehesht 9, Mostafa Abdi was taken from Evin prison to Branch 15 of the Tehran Revolutionary Court to investigate charge of “gathering and colluding to disturb national security”.
The court presided over by Judge Salavati (who did not grant permission for other attorneys of this prisoner of conscience to attend the session), was held in the presence of only one of his defense lawyers therefore he refused to defend himself and told Judge Salavati: “According to article 185 of the Code of Criminal Procedure Public and Revolutionary Courts, the defender lawyers should be allowed to read the client’s case and because the law has not been implemented in my case and my lawyers did not have present in court so I have no defense now. According to my regulated Power of attorney, my lawyers are only allowed to collective defense (Collective attorneyship) not individual ( Individual attorneyship), so I cannot defend myself in court until my lagal demands are met with the right of my attorneys to appear in the court.
According to reports by Majzooban Noor, Mostafa Abdi who was arrested along with more than 15 other Dervish lawyers and managers of Majzooban Noor website ( Nematollah Gonabadi Order News Site) in Shahrivar last year (September 2011) in Tehran and had been released on bail bonds salary after enduring more than one month behind bars in security Ward 209 of Evin prison, on 11th of Bahman 1391(Jan 30, 2013) was again summoned to Evin Court to post his bail which has been set in the amount of 100 million toman under order from judge Salavati. But he refused to post bail so was taken to Section 350 of Evin prison.
This Gonabadi Dervish has been twice summoned to appear in Branch 15 of Tehran Revolutionary Court presided over by Judge Salavati to investigate charge of “gathering and colluding to disturb national security” and each time he refused to defend himself due to illegal hearing procedure and because his lawyers did not have present in the court. Then Judge Salavati threatened the Dervish to arrest and transfer him directly to prison and also forwarded his case to Evin Court to reconsider and increase the amount of the bail but Mr. Abdi has announced that, he is not going to pay bail and went to jail, so currently nine Gonabadi dervishes are detained in Evin Prison.
