After arrestment of Mr.Mustafa Daneshju, the lawyer of Gonabadi Dervishes, by
ten of plain clothes security forces, there is still no news about the place
he has been kept. According to the reporter of
Majzoobannoorwebsite,
hisadvocate’slicense has been voided by the center of Juridical Counselors’ Affairs, because of defending Dervishes civilrights.He was arrested in his office yesterday 18th may 2011,and transferred to an unknown place. In 2005 after destruction of Hosseinye-Shariat in Qom by official and security forces, he decided to attend the court to defend Nematallahi dervishes.
In April 2006 intelligent service of Neka(a township in Mazandaran province)in a totally biased report, noticed the public prosecutor that two Dervishes have been involved in preparation and distribution of anti basijand Ayatollah Khamenei CDs.According to this report,in pretext to identify the elements and collecting the CDs, intelligent serviceof Neka requested Neka prosecutor for call and house inspection permission for these two dervishes. Finally, home inspection permission issued insisting complete pre-investigation and full assurance of crimeoccurrence, in such a case,they should be firstly warned and notified and in case of abstain and refusal, house inspection must be executed according to the regulations and religious requirements, but intelligent service agents neglecting the law and civil rights and without any further investigation entered in Dervishes’ houses and confiscate irrelevant items such as Sufibooks.
After illegal act of agents, two dervishes filed a suit against them in public prosecutor’soffice. To follow their complaints, court referred them to the police security service center to identify the willful agents who entered their houses without legal permission and breaching their privacy.
This whole story showed that the juridical authorities were not aware of this law breaking action by the security agents. Mustafa Daneshju attended a military court to take a legal actionagainstthe law breakers and asked the court to identify and punish them according to law. But at the same time, the intelligent service of Mazandaran provinceset a chimerical complaint and accused him to slander and effluence of lie to disturb official authorities. Following this accusation, he was arrested in October2007 and was kept in an isolated cell and finally sentenced to 35 flog strokes and 7 months prison, a judgment by default issued by penal court of division no. 107.By issuing such command, his attorneys made complaint in court of reconsideration and, he became acquitted from the accusation of slander and insult, but his 7 months prison was confirmed. This time his attorneys made complaint Supreme Court. According to the evidences and reasons,the Supreme Court found that Mr. Daneshju had rightfully done his duty to truly defense his clients and he was only pleading for justice. Judgesof Supreme Court breached the vote of lower court and ordered to reinvestigatethe case. However in a very strange action, court of reconsideration regardless ofSupreme Court opinion, confirmed the 7 months prison.
