Mr. Saleh Moradi, without any prior notification was transferred from prison to Branch 110 of Shiraz’s public and Criminal court (Atlassi Branch) to defense, yesterday morning on 16th Aban 1391 (Nov 6, 2012).
According to Majzooban reporter, Gonabadi dervish, Mr. Saleh Moradi who has been held for more than 14 months in Shiraz Adel Abad prison, without any prior notification was transferred from prison to Branch 110 of Shiraz’s public and Criminal court (Atlassi Branch) to investigate his charge of “spreading lies”.
Mrs. Farzaneh Nouri and Messrs.Saleh Moradi Sarvestani, Behzad Nouri and Farzad Darvish had been summoned to appear in Shiraz Investigative court on charge of “spreading lies” Tuesday morning on 9th Aban 1391 (Oct 30, 2012) too, but they refused to attend the court hearing becouse dervishes received a court summons by just phone which is not accordance with Law and phone summons have not been mentioned in any legal code, his defender lawyer said.
The attorney added that by operation of law, in criminal cases, lawyer and client should always receive notification in writing and the time interval between “notification and action” must be at least 5 days but in this case only one of the lawyers was announced by phone three days before hearing date so due to non-observance of law, the court session must be reconsidered.
It should be mentioned that, a similar trial, whitout lagal formalities was set for these Gonabadi dervishes last week.
At this meeting Mr. Saleh Moradi who had been forcibly taken to court from jail, said to trial judge: “because I have been never allowed to meet with my lawyer up to now and no summons has been received for my lawyer, I have no defense here” and the judge also by stating that, this method of summoning is completely illegal, said that the trial should be reconsidered.
Unfortunately, Judicial misconduct continues about Gonabadi dervishes’s trails as in the case of Gonabadi dervishes’s lawyers and Majzooban Noor websit’s managers in Tehran despite there is less than four days before the court date but some of their defender lawyers received no summons to appear in court on the hearing date yet and clients have been never allowed to meet with their lawyers!
